If you are a coal miner who has a disabling pulmonary condition because of your exposure to coal dust and rock dust in your coal mining employment, contact your local US Department of Labor authorized Respiratory and Disease Clinic for an examination and help in filing a claim for Coal Workers’ Pneumoconiosis (CWP). If you are a widow or widower and your spouse was disabled by CWP or died as a result of CWP, contact the Respiratory and Disease Clinic nearest you for help in filing a survivor’s claim.
In a Miner’s claim, you must file a claim for benefits within three (3) years of a medical diagnosis informing you that you are totally disabled because of your coal mining employment related CWP. There is no statute of limitations for a widow/widower’s claim.
