Report your injury as soon as possible and request workers’ compensation benefits.

Your employer is not going to inform you of your rights. Ask your Union or ask a co-worker. Request a CA-16 form to get your medical bills paid. Go to the medical provider of your choice. Fill out and give to your supervisor a CA-1 form for a traumatic injury, and a CA-2 form for an occupational exposure/repetitive motion injury. If you suffer a traumatic injury and are unable to work, your employer is supposed to continue your pay (COP) for 45 calendar days before workers’ compensation pay starts.

There is a three-year statute of limitations period in which you must file your claim or be untimely.

There is a two-year statute of limitations from the date of your injury or from the last date for which you have been paid compensation in which to file an Application for Adjustment of Claims with the Indiana Workers’ Compensation Board or be untimely.

If you are a coal miner who has a disabling pulmonary condition because of your exposure to coal dust and rock dust in your coal mining employment, contact your local U.S. Department of Labor authorized Respiratory and Disease Clinic for an examination and help in filing a claim for Coal Workers’ Pneumoconiosis (CWP). If you are a widow or widower and your spouse was disabled by CWP or died as a result of CWP, contact the Respiratory and Disease Clinic nearest you for help in filing a survivor’s claim.

In a Miner’s claim, you must file a claim for benefits within three years of a medical diagnosis informing you that you are totally disabled because of your coal mining employment-related CWP.  There is no statute of limitations for a widow/widower’s claim.
